We make every effort to display our products accurately, including descriptions, images, and pricing. However:

Individual results from using our Purple Teeth Whitening Strips may vary. Results depend on individual factors such as existing tooth shade, oral hygiene habits, and consistency of use
Our products are cosmetic in nature and are not intended to diagnose, treat, cure, or prevent any disease or medical condition

Product Use Disclaimer

Wellio Purple Teeth Whitening Strips are formulated with PAP (Phthalimidoperoxycaproic Acid) and color-correcting violet pigments. Our strips are peroxide-free. This product is intended for cosmetic use on natural teeth only. Do not use on dental restorations (veneers, crowns, bridges, or dentures) as results may vary. If you have existing dental conditions, gum disease, or sensitivity issues, consult your dentist before use.

3. Orders and Payment

Placing Orders

All orders are subject to acceptance and availability
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized transactions, or product unavailability
An order confirmation email does not constitute acceptance. Acceptance occurs when we ship the product

Pricing

All prices are listed in US Dollars (USD)
Prices are subject to change without notice
We are not responsible for pricing errors. If an error is discovered after your order is placed, we will notify you and offer the option to proceed at the correct price or cancel
Applicable sales tax will be added at checkout based on your shipping address and state requirements

WE DO NOT WARRANT THAT OUR PRODUCTS WILL ACHIEVE ANY SPECIFIC WHITENING RESULTS. INDIVIDUAL RESULTS VARY BASED ON NUMEROUS FACTORS INCLUDING TOOTH CONDITION, DIET, AND USAGE CONSISTENCY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WELLIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO:

Your use of or inability to use the Site or products
Any product you purchase through the Site
Unauthorized access to or alteration of your data
Any third-party conduct on the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wellio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

Your use of the Site
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the Site

12. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.

Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@wellioskin.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Sheridan, Wyoming. You agree that arbitration shall be conducted on an individual basis and not as a class action.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THE ENTIRE ARBITRATION PROVISION SHALL BE VOID.

Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

13. Termination

We reserve the right to terminate or suspend your access to the Site at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Wellio regarding your use of the Site and supersede any prior agreements.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the modified Terms.
